Terms of Service

These Terms of Service (“Terms”) govern your use of the Zapito website and platform. By creating an account or using Zapito you agree to these Terms.

1. The service

Zapito provides tools to build, test and deploy AI chat agents on messaging channels such as WhatsApp, plus related analytics and billing features. We may add, change or remove features as the product evolves.

2. Your account

You must provide accurate information, keep your credentials secure, and be at least 16 years old. You are responsible for activity in your workspace, including teammates you invite.

3. Your content and data

You retain all rights to the workflows, prompts, knowledge content and conversation data in your workspace. You grant us the limited licence needed to host and process that content to operate the service. We process your end-users’ conversation data on your behalf and under your instructions.

4. Acceptable use

You agree not to use Zapito to:

  • send spam or unsolicited messages, or violate the policies of connected messaging platforms (including Meta’s WhatsApp Business terms);
  • break the law, infringe others’ rights, or distribute malicious content;
  • mislead end-users about whether they are talking to an AI when disclosure is legally required;
  • probe, disrupt or circumvent the security or rate limits of the service.

We may suspend or terminate accounts that violate these rules or that put other customers or our platform relationships at risk.

5. Third-party platforms and providers

Connecting a channel (e.g. WhatsApp, Telegram) or an AI model provider means you also agree to that third party’s terms. Your channel assets (such as your WhatsApp Business Account) remain yours. We are not responsible for third-party services, their availability or their decisions (such as platform enforcement actions).

6. Bring-your-own keys and credits

If you bring your own model API keys, usage is billed directly by your provider and you are responsible for those costs. If you use Zapito-managed credits, usage is deducted per our published pricing. Fees are non-refundable except where required by law.

7. AI output disclaimer

AI-generated responses can be inaccurate. You are responsible for reviewing how your agents are configured, the knowledge they rely on, and any obligations you have to your own customers regarding automated communications.

8. Availability and support

We aim for high availability but the service is provided “as is” without warranties of any kind. We may perform maintenance that temporarily affects availability.

9. Limitation of liability

To the maximum extent permitted by law, Zapito will not be liable for indirect, incidental, special or consequential damages, or loss of profits, revenue or data. Our total liability for any claim is limited to the amounts you paid us in the 12 months before the claim.

10. Termination

You can stop using Zapito and delete your account at any time. We may suspend or terminate the service for breach of these Terms with notice where practicable. Sections that by their nature should survive (3, 6, 9) survive termination.

11. Changes to these Terms

We may update these Terms; material changes will be announced by email or in-product notice before they take effect. Continued use after changes take effect constitutes acceptance.
